The purpose of these general terms and conditions of use (the "GTCU") is to provide a legal framework for the provision of the site and its services and to define the conditions of access to and use of MyTower's services.
These GCU are available on the site under the heading "GCU".
PREAMBLE
MyTower, a SAS with capital of €2,134,330, headquartered at 183 rue de la Pompe, 75016 Paris, registered with the Paris Trade and Companies Register under no. B 843 849 134, represented by Jean-Christophe CUVELIER.
MyTower (hereinafter referred to as "the Organization") is the publisher of sites, online content and services and mobile or tablet digital media, accessible on all digital terminals and available when Visitors connect.
Each of the terms mentioned below shall have the following meaning in these General Terms and Conditions of Use (hereinafter referred to as the "GTCU"):
Sites and Digital Media: websites, mobile sites and digital media intended for Visitors (hereinafter referred to as "Sites and Digital Media").
Personal Data: any information relating to a natural person who is identified or can be identified, directly or indirectly, by reference to a name, an identification number or one or more factors specific to that person.
Services: all functionalities made available to Visitors by the Organization and available on the site and digital media.
Visitor: any individual or legal entity accessing the site and digital media for the purposes of simple consultation and without using a personal account linking him/her to the Organization.
Any registration or use of the site implies the Visitor's unreserved and unrestricted acceptance of these GCU. When browsing the site or requesting contact via the contact form, each Visitor expressly accepts these GCU by ticking the box preceding the following text: "I acknowledge that I have read and understood the GCU and accept them".
In the event of non-acceptance of the GCU stipulated in the present contract, the Visitor must renounce access to the services offered by the site.
The organization reserves the right to unilaterally modify the content of these GCU at any time. Visitors will be informed of any changes via the organization's website.
The Organism's site provides the Visitor with access to the following services:
Access to the site and services is possible twenty-four (24) hours a day, seven (7) days a week, except in the event of force majeure or an event beyond the control of the Organization, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the site and services, which may be carried out without prior notice to the Visitor.
The Visitor sends the Organization a request for information via the contact form or any other means (e-mail, telephone, etc.). The Organization sends an e-mail in response to each Visitor.
Visitors may contact the Organization at any time using the contact form available on the site.
MyTower undertakes to process all personal data under this contract in accordance with the European Data Protection Regulation (RGPD) that came into force on May 25, 2018.
Data is confidential within the meaning of Regulation (EC) No. 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. MyTower will restrict access to data to personnel strictly necessary for the performance, management and monitoring of the contract.
In accordance with the French Data Protection Act of January 6, 1978 and the Personal Data Protection Regulation, Visitors have the right to access, oppose, delete, port, limit and rectify information concerning them.

Trademarks, logos, signs and all site content (text, images, sound, etc.) are protected by the French Intellectual Property Code and, more specifically, by copyright.
The " " trademark is a registered trademark of the Organisme. Any representation and/or reproduction and/or partial or total use of this trademark, of any nature whatsoever, is totally prohibited.
The Visitor must request prior authorization from the site for any reproduction, publication or copy of the various contents. The Visitor undertakes to use the contents of the site in a strictly private context. Any use for commercial or advertising purposes is strictly forbidden.
Any total or partial representation of this site by any means whatsoever without the express authorization of the website operator constitutes an infringement punishable by article L 335-2 et seq. of the French Intellectual Property Code.
In accordance with article L122-5 of the French Intellectual Property Code, any Visitor who reproduces, copies or publishes protected content must cite the author and source.
When using the site, Visitors undertake to :
To comply with the stipulations described in the GCU and with the laws in force, and to respect the rights of third parties;
To communicate only information, files and other content that are true, honest and fair;
Not to publish advertisements whose purpose is the promotion of products or services;
Not to divulge personal information (texts, photos and videos) of third parties via the Organization's site without their consent;
Not to import and disseminate via the Organization's site any unlawful statements or content, and in particular any content that is infringing, defamatory, abusive, obscene, offensive, discriminatory, violent, xenophobic or inciting to racial hatred ; or any other content contrary to good morals and decorum;
Not to include or disseminate via the Organization's site any content that is contrary to the purpose of our Service;
Not to communicate or send, via the Organization's site, any content whatsoever that includes links pointing to illicit or offensive websites or that are incompatible with the purpose of the Organization's service;
To use the Organization's site to send unsolicited mass messages (advertising or other).
Furthermore, the Visitor expressly guarantees the truthfulness and accuracy of the information transmitted via our contact form.
In the event of a breach of one or more of these obligations, we reserve the right to exclude the offending Visitor from the Organization's service.
The sources of the information published on the Organisme site are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions.
The information provided is for general guidance only and is not contractually binding. Despite regular updates, the Organisme website cannot be held responsible for any changes in administrative or legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information it contains.
The Organisme website cannot be held responsible for any viruses that may infect the computer or any other hardware of the Internet user, following use, access or downloading from this site.
The Organisme website cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
Hypertext links may be present on the site. Visitors are informed that by clicking on these links, they will leave the Organisme's site. The Organisme has no control over the web pages to which these links lead, and cannot under any circumstances be held responsible for their content.
The decision to activate these links is the sole responsibility of the Visitor. The Organisme has no control over these sites and accepts no responsibility for their access, content or use, nor for any damage that may result from consulting the information on these sites.
The contract is subject to French law.
In the event of a dispute concerning the interpretation or execution of the present contract, the parties agree to enter into a preliminary amicable phase.
The Visitor is hereby informed that he/she may in any event have recourse to mediation with existing industry mediation bodies, or to any alternative dispute resolution method in the event of a dispute.
Failing amicable settlement, the parties agree to submit the dispute to the Paris courts, which have jurisdiction over the contract.
